Custody and Parenting Time
Kentucky child custody laws favor an arrangement that strives to maximize the time that children spend with parent, assuming that this is possible and in the best interests of the children. Shared parenting arrangements involve developing a parenting plan in which both parents have joint legal custody and parenting time is divided as equally as possible.
Shared Parenting Plan
In Kentucky, parents will almost always share joint legal custody, which means that both parents must agree on matters affecting the child's education, religious upbringing, health care and other major decisions. The amount of time the child or children spend with each parent is determined by shared parenting plan. Sole custody is an arrangement whereby one parent has primary physical custody and the right to unilaterally make decisions affecting the child or children and the other parent has visitation rights.
