A spouse, child or other close personal relation should never have to tolerate domestic violence. The law affords victims of domestic violence and spousal abuse with significant amounts of protection against continued violence through an emergency protective order (EPO). You can obtain this order — to get the perpetrator out of the house or to prohibit him or her from coming within a certain distance of your home — by going to your county courthouse or by calling the police.

Defending People Accused of Domestic Violence

Despite the fact that the courts take a hard line on domestic violence and physical abuse allegations, they still afford a person the ability to challenge a personal protection order. After the court grants an EPO, it must hold a hearing with 14 days to allow the alleged perpetrator the opportunity to defend himself or herself. It is important to challenge these orders because they could last up to five years, affect your employment status, prevent you from owning a firearm and even affect your parental rights.
