Rehabilitative Maintenance in Kentucky Divorces

In Kentucky, courts can award spouses with what is called rehabilitative maintenance — commonly referred to as alimony. This form of financial support is available to allow spouses the chance to better their position to make a decent living. In some situations, this is available until a spouse reaches retirement age — this is especially true for older individuals who would have a difficult time in reentering the workforce.

There are no set formulas available to the court to calculate rehabilitative maintenance. The court will consider the spouse's ability to pay compared to a spouse's need. The goal is to provide the same standard of living enjoyed by the spouse during marriage until he or she can earn a living independently.
