Enforcement and Contempt of Child Support Orders
While the non-payment of child support under Kentucky law CANNOT deprive the payor parent from having visitation time with the child, if the overdue child support reaches more than $1,000.00, that payor parent may face felony criminal chares and jail time. I help both the recipient parent and the paying parent to pursue, and defend against, contempt and enforcement actions. In every instance, I always keep the best interests of your child at heart, and always follow a strategy that protects your child.
Modifications to Child Support Orders
Child support is always subject to modification when there have been significant changes in the circumstances of either parent, or the child. It is possible to get an increase or to have child support reduced in the event of major income changes, employment changes, or unemployment, that leaves the payor parent unable to pay child support, or for the changing medical or other special needs of the child.
I can help either the paying or the recipient parent to get an order changed, or to defend against a child support modification. It is crucially important for a payor parent who can no longer afford the child support which has been ordered to contact a child support attorney as soon as possible so that proper motions can be filed to prevent the payor parent from the consequences of falling behind in child support, which quite often involves being charged with the felony of flagrant nonsupport.
